On or before November 21, 1816, at Southampton County, Virginia, Chancery File 1816-039, Henry D. Inman and his wife Rebecca (Judkins) Inman filed their complaint for a sale of the land of Bynum Judkins deceased, the other heirs of Bynum Judkins agreed, and the Court approved that sale: "To the worshipful Court of Southampton in Chancery sitting. Humbly complaining shew unto your worships your complainants Henry D. Inman and Rebecca his wife late Rebecca Judkins and Jordan Judkins an infant by his next friend the said Henry D Inman - That Bynum Judkins late of this County an infant departed this life in December last seized of two several parcels or tracts of land lying in this County the one containing 35 acres and the other 34½ That the said Bynum died unmarried and without issue leaving William Judkins, Gray J Judkins and the complainant Jordan his brothers and the female complainant Rebecca and Cherry Judkins his sisters, and a nephew George Washington son of Thomas Washington and Martha his wife late Martha Judkins That the brothers and sisters aforesaid and George Washington the nephew of the said Bynum are equally entitled to the land of which the said Bynum died seized. Your complainants represent to your worships that that the two several tracts of land aforesaid are not worth one hundred dollars a share to the parties and that therefore to effect a division of the same it should be sold under and by virtue of an act of the General Assembly in such cases made and provided. In tender consideration whereof and in as much as your complainants are without remedy save in a Court of Equity where matters of this kind are properly cognizable they pray that the aforesaid parcels of land may be sold and the proceeds of the sale be divided among the parties according to their respective. And they pray that the said Wm Judkins Samuel Judkins Gray J Judkins, Cherry Judkins and Geo Washington who is an infant may be made defendants hereto and be compelled to answer all and singular the allegations herein contained fully and unevasively and they further pray for general relief.

Harwall or any two of them do expose to public sale after giving reasonable public notice of the time and place of sale the two several tracts of land lying in this County whereof Bynum Judkins died seized the one tract containing 35 acres and the other 34½ acres on a credit of months, and divide the proceeds of the sale into seven equal parts, taking bonds with approved security for the payment of each separate part, and that they assign one seventh part to the complainants Henry D. Inman and Rebecca his wife in right of his wifes 1/7th part to the Complainant Jordan Judkins, and 1/7 part to each of the defts William Judkins Samuel Judkins, Gray J Judkins Cherry Judkins and George Washington and that they make report to this Court in order to a final decree
